These terms are an agreement between you or the organisation you represent ("you") and Ajaxter ("we") for the FacePass terminal app, the FaceConnect employee app, the admin panel and website (together, the "Service"). By using the Service you accept these terms.
1. The Service
FacePass lets a business record attendance with face recognition on Android terminals and manage the records in a web panel. Features may change as the Service improves.
2. Accounts
- You must give accurate information and keep your sign-in details secret. You are responsible for what happens under your accounts.
- The person who registers a business confirms they are allowed to do so on its behalf.
- Tell us promptly if you suspect unauthorised use.
3. Acceptable use
- Use the Service only for lawful workplace attendance and related administration.
- Do not try to break, probe or overload the Service, bypass its security, copy it, or reverse engineer it, except where the law allows.
- Do not use it to enrol or track anyone without the legal right to do so, and do not upload unlawful or malicious content.
4. Biometric data and your responsibilities
You decide who is enrolled. Before enrolling anyone you must inform them and obtain any consent or other legal basis required by the laws that apply to you. You must configure and use the Service in line with those laws, and you remain responsible for decisions you take using attendance records. See our privacy policy for how we handle the data.
5. Accuracy
Face recognition and liveness checks depend on cameras, lighting and conditions, and are not perfect. Results can contain errors, and no system can promise to stop every spoofing attempt. You should test the Service in your environment, keep sensible supervision and review important records before acting on them.
6. Your data
You keep your rights in your data. You give us the right to process it to provide the Service, as described in the privacy policy. You can export your data and request deletion at any time; see data deletion.
7. Availability and support
We work to keep the Service available, but we do not promise that it will be uninterrupted or error-free. The terminal is designed to keep recording attendance while offline. We may carry out maintenance and will try to give notice of significant interruptions.
8. Fees
Fees, if any, are agreed with you in an order or quote. Unless agreed otherwise, they are payable in advance and non-refundable except where the law requires.
9. Intellectual property
We and our licensors own the Service, its software, design and trade marks. We give you a limited, non-exclusive, non-transferable right to use it for your internal business purposes while these terms apply. Third-party components are used under their own licences.
10. Suspension and termination
You may stop using the Service at any time. We may suspend or end access if you breach these terms, put the Service or others at risk, or fail to pay. On termination you may export your data, and deletion follows the process in the privacy policy.
11. Disclaimer and liability
The Service is provided "as is" to the extent the law allows. To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, or loss of data caused by events outside our reasonable control, and our total liability for any claim is limited to the fees you paid for the Service in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
12. Changes
We may update these terms. If a change is material we will notify you through the Panel or by e-mail. Continuing to use the Service after the change means you accept it.
13. Governing law
These terms are governed by the laws of India, and the courts of India have jurisdiction, without affecting any mandatory consumer rights you have where you live.
